Digitalization Era in Consumer Notifications

There have been important amendments published on the official gazette on 5 November 2020 that will come into force by 1 January 2021 with respect to consumer regulations, namely Warranty Certificate Regulation, User’s Manuel Regulation and Post-Sales Services Regulation.

Warranty Certificate Regulation:

With the amendment, it would be possible to issue the warranty certificate by means of permanent data storage unless the consumer requests a printed copy.

[Permanent data storage has been defined in the Regulation as internet, cd, dvd, e-mail, sms, memory card and the similar devices and methods.]

 User’s Manuel Regulation:

With the amendment, it would possible to deliver the user’s manual in digital form (permanent data storage) to the consumer unless the consumer requests a printed copy. If the user manual is given with a permanent data storage, the necessary information shall be provided by the manufacturer or importer on the product or on its package as to how to access to the user’s manual.

 Further, the below two paragraphs shall have to be added to the user’s manual:

  • If there is a web site of the manufacturer or the importer, information that the site contains up-to-date contact information regarding all authorized service stations and the places where spare parts could be obtained.

  • Information that all authorized service station information is included in the Service Information System created by the Ministry.

 Post-Sales Services Regulation:

The document showing the receipt of the product by the service can also be given to the consumer with a permanent data storage.
